《外贸跨境电商:被投诉品牌侵权,要怎么申诉》
在12月27号的时候,有一个链接被亚马逊下架了,邮件提示侵犯了商标权。我查了一下,这个商标是因为某个卖家把这类产品的关键词注册为商标,我的链接标题,产品描述里面有使用到这个关键词,导致我的链接被下架。
收到邮件后我做了以下处理:
1:把链接里面出现这个关键词的地方全部删掉。(搜索关键词里面也要删掉,亚马逊检测的到)
2:尽可能的把标题,产品描述,5要素简单化,这样子可以避免因为其他的关键词被审核。
3:联系亚马逊英文客服,但是英文客服回复的比较慢。当天我选择用模板刷新我的链接内容。(在后台更改的话,是没有权限的)
4:在数据更新之后,发申诉信给亚马逊相关的团队。
发送申诉信的24小时之后,亚马逊没有回复,我又重新发送了一封。第2天显示链接可售,评价也恢复了。
申诉内容如下,仅供参考
Dear Sir or Madam,
Thank you for giving us this opportunity to appeal. After receiving your warning email, we found that our products may violate Amazon’s Intellectual Property Policy. We immediately conducted an investigation and found that our products of ASIN: XXXX did violate the trademark infringement of the right owner, but please believe us that we did not intentionally do that. The following are the root causes of this incident and the measures we have taken to resolve and prevent it.
According to the patent number 8XXX mentioned in your warning email, we have checked relevant information in the official website of USPTO. I found that the keyword “XXX” I used in the Asin has been registered as a trademark. Here are the trademark infringemen owner’s message we checked out.
So, I changed the title and product description of the link in the background for the first time,deleted the words XXX, and contacted Amazon customer service to help me recheck it to ensure that other people’s trademarks no longer appear. We are aware that the problem has been positively modified and we have now made sure that there is no infringement.
We believe that with our continuous efforts, we will have a better understanding of Amazon’s sales policy and become an excellent Amazon seller. We would appreciate it if you could give us another chance.
